Terms and Conditions

1. Definitions

The term ´Goodgrip´ or ´us´ or ´we´ refers to the owner of the website whose registered office is Goodgrip Tyres ltd, St Bride´s House, 10 Salisbury Square, London, EC4Y 8JD. Goodgrip´s company registration number is 0773948 and our VAT number 121 2826 51. The term ´you´ refers to the user or viewer of our website and/or customer of goodgrip.co.uk. ´Conditions´ means these terms and conditions for the sale of tyres and wheels and tyre and wheel fitting services. ´Goods´ means the tyres and/or wheels (including any fitting of the tyres and/or wheels or any parts for them) or services which Goodgrip is to supply in accordance with these Conditions.

2. Use of the Goodgrip website

2.1. The content of the pages of the Goodgrip website is for general information and use only. It is subject to change without notice.

2.2. The website may use cookies to monitor browsing preferences.

2.3. Neither we nor any third parties provide any warranty or guarantee, except as covered by Clause 5.2, as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Goodgrip website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

2.4. Your use of any information or materials on the Goodgrip website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

2.5. The Goodgrip website contains material which is owned by or licensed to Goodgrip. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

2.6. All trademarks reproduced in the Goodgrip website, which are not the property of, or licensed to the operator, are acknowledged on the website.

2.7. Unauthorised use of the Goodgrip website may give rise to a claim for damages and/or be a criminal offence.

2.8. From time to time, the Goodgrip website may also include links to other websites. These links are provided for user convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

2.9. Your use of this website and any dispute arising out of such use of the website is subject to the laws of England, Northern Ireland, Scotland and Wales.

3. Sales

3.1. Customers must be of at least 18 years of age.

3.2. All customer orders shall be processed and confirmed to the customer within 24 hours during normal workdays.

3.3 The Customer´s order shall not be deemed to be accepted by Goodgrip unless and until the order confirmation has been issued to the Customer.

3.4. The price of the Goods shall be the price specified by Goodgrip in the order confirmation, or, where no price is quoted in the order confirmation, the price listed in Goodgrip ´s price list or website text on the Goodgrip website current at the date and time of the order confirmation.

3.5. The price of the Goods shall be inclusive of any applicable Value Added Tax.

4. Terms of Payment

4.1. Subject to any special terms agreed in Writing between the Customer and Goodgrip, Goodgrip shall be entitled to payment in full for the price of the Goods (including VAT) on the date of the Customer´s order. Goodgrip shall debit the Customer´s credit/debit card or Paypal account with payment in full for the Goods and applicable Value Added Tax on or after the date of the Customer´s order.

4.2 The Customer shall be obliged to pay the price of the Goods on the date of the Customer´s order. Goodgrip shall be entitled to recover the price of the Goods, notwithstanding that delivery may not have taken place and the property in the Goods has not passed to the Customer. The time of payment of the price shall be of the essence of the Contract. Receipts for payment will be issued.

4.3 If the Customer fails to make any payment by the relevant due date or if payment is declined or not authorised by the issuer of the Customer´s credit/debit card when processed by Goodgrip then, without prejudice to any other right or remedy available to Goodgrip, Goodgrip shall be entitled to: 4.3.1 cancel the Contract or suspend any further deliveries to the Customer; 4.3.2 appropriate any payment made by the Customer to such of the Goods (or the goods supplied under any other contract between the Customer and Goodgrip) as Goodgrip may think fit (notwithstanding any purported appropriation by the Customer); and 4.3.3 charge the Customer interest (both before and after any decree or judgement) on any amount unpaid, at the rate of four per cent per annum above the Bank of England base rate from time to time, until payment in full is made (a part of a month being treated as a full month for the purpose of calculating interest).

5. Delivery and fitting

5.1. Goodgrip shall incur no liability resulting from inaccurate information being supplied by the Customer. Should the customer have made modifications to their car that do not match the original factory specifications, such as larger diameter wheel rims than as specified in the original product specification for the car, it is the customer´s responsibility to inform Goodgrip of the non-standard specifications. When buying tyres or rims as separate goods via the website, it is the customer´s responsibility to make sure said goods have the same diameter to allow mounting of the tyre to the rim.

5.2. Goodgrip guarantees that when a search is carried for a complete tyre, tyre or rims through www.goodgrip.co.uk "fastsearch" that the products identified by the search fits car whose details were entered. In the unlikely event of incorrect information being present in our database, Goodgrip will take full responsibility and replace the incorrectly suppied products without any further delivery cost to the customer. Goodgrip shall not be responsible for any further costs incurred by the customer as a result of the supply of an incorrect product.

5.3. Delivery of the Goods shall be made by Goodgrip or its nominated carrier delivering the Goods to the delivery address specified in the order confirmation, the chosen Goodgrip fitting partner or such other address provided by the customer and approved by Goodgrip.

5.4. Any dates quoted for delivery and/or fitting of the Goods are approximate only and not guaranteed and Goodgrip shall not be liable for any delay in delivery and/or fitting of the Goods howsoever caused.

5.5. If the Customer fails to take delivery of the Goods or fails to give Goodgrip adequate delivery instructions in the Customer´s order then, without prejudice to any other right or remedy available to Goodgrip, Goodgrip may store the Goods until actual delivery and charge the Customer for the reasonable cost and/or return the Goods to the supplier and charge the Customer for any costs incurred as a result of such return. In the case of mounted tyres (complete wheel; Tyre mounted to rim by Goodgrip prior to dispatch) an extra cost for dis-mounting will be charged.

5.6. Delivery of the Goods shall be evidenced by the return to Goodgrip of its or its authorised carriers´ official packing/delivery note which, howsoever signed as acknowledgement of receipt of the goods, shall constitute absolute proof of delivery of the items specified in it.

5.7. Goodgrip.co.uk takes full economic responsibility if the goods get lost or get damaged during transport. It is the Customer´s responsibility to report any such damage to Goodgrip and its authorized courier immediately. If the damage is not discovered until after packaging is removed Goodgrip´s customer service must be contacted within 48 hours of the receipt of the delivery or within 24 hours of the discovery of the damage.

5.8. Damage to wheels caused by stoneshots and damage inflicted by tools during mounting, dismounting, balance and fitting will not be compensated for or accepted as acceptable grounds for return.

5.9. In the event that customer feels that their pre-mounted tyres (tyres that were fitted to rims by Goodgrip prior to despatch) feel unbalanced it is the responsibility of the Customer to contact Goodgrip customer services. Goodgrip will then book an appointment with an authorised fitting partner to check the balance of the wheels. The costs of this inspection appointment must be paid direct to the nominated fitting partner by the Customer. Reimbursement for this cost up to a total value of £50 (inclusive of Value Added Tax) shall be paid by Goodgrip to the Customer upon provision of a receipt for the agreed inspection and subsequent rebalancing of the tyres if necessary. This is only applicable to those customers who have purchased a complete wheel(s) from Goodgrip where the tyre(s) were mounted to the rim(s) by Goodgrip prior to delivery to the customer.

6. Risk, Liability and Property

6.1. Risk of damage to or loss of the Goods shall pass to the Customer when the Goods are delivered to the delivery address specified in the Customer´s order or such other address as shall have been approved of in advance by Goodgrip or in the case of Goods which the customer has chosen upon order to have fitted by an authorized fitting partner, at the time when the Customer is notified that the Goods have been fitted and are ready for collection.

6.2. Notwithstanding delivery and the passing of risk in the Goods, or any other provision of these Conditions, the title to and liability for the Goods shall not pass to the Customer until all sums due by the Customer to Goodgrip (including any applicable interest and charges) have been paid in full.

6.3. Goodgrip shall be under no liability in respect of any defect in the Goods arising from reasonable wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow Goodgrip ´s instructions (whether oral or in writing) or misuse or alteration or repair of the Goods without Goodgrip ´s approval.

6.4. Where any valid claim in respect of any of the Goods which is based on any defect in the quality or condition of the Goods or their failure to meet specification is notified to Goodgrip in accordance with these Conditions, Goodgrip shall be entitled to replace the Goods (or the part in question) free of charge or, at Goodgrip ´s sole discretion, refund to the Customer the price of the Goods (or a proportionate part of the price), but Goodgrip shall have no further liability to the Customer or any other person.

6.5. Except in respect of death or personal injury caused by Goodgrip ´s negligence, Goodgrip shall not be liable to the Customer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of Goodgrip, its employees or agents or otherwise) which arise out of or in connection with the supply or fitting of the Goods or their use or resale by the Customer, and the entire liability of Goodgrip under or in connection with the Contract shall not exceed the price of the Goods, except as expressly provided in these Conditions.

6.6. Goodgrip shall not be liable to the Customer or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of Goodgrip ´s obligations in relation to the Goods, if the delay or failure was due to any Force Majeure or other cause beyond Goodgrip ´s reasonable control.

7 Cancellation, Returns and Refunds

7.1. Subject to Clause 7.2, the Customer´s order may not be cancelled by the Customer after the order confirmation has been issued except with the agreement in writing of Goodgrip and on terms that the Customer shall indemnify Goodgrip in full against all loss (including loss of profit), costs (including the cost of all labour and materials used), damages, charges and expenses incurred by Goodgrip as a result of cancellation by the Customer of the Customer´s order.

7.2. In the case of the delivery direct to the customer and delivery to a an authorized fitting partner for fitting of the Goods and subject to Clause 8.3, within 14 days of the day after the day of delivery of the Goods to the Customer, or before the arranged fitting date, the Customer shall be entitled to cancel the Contract, return the Goods and receive a full refund (or where the goods have not been paid for, full credit), provided that the Goods have not been used in any way, are in the same good condition in which they were received by the Customer and are returned to Goodgrip. In such event the Customer shall be responsible for the costs of returning the Goods and shall indemnify Goodgrip or demand against all and any such costs. If Goodgrip collect the goods, Goodgrip retains the right to charge the customer for any direct costs associated with the return of the goods. No additional restocking charge or administrational charge will be added in accordance with distance selling regulations. Goodgrip.co.uk customer service centre can be contacted for an accurate cost on returning goods as costs may vary depending on tyre specification and location

7.3. Subject to Clause 8.1, refunds to the Customer are entirely at the discretion of Goodgrip. In the event that Goodgrip, in their sole discretion, grant a refund to a Customer, any costs incurred by Goodgrip in procuring that refund shall be borne by the Customer.

7.4. If the customer has damaged the rims or tyres they ordered in any way Goodgrip will not be able to compensate for the Goods.

7.5. In the case of the return to Goodgrip by the Customer for any reason of mounted tyres (complete wheel; tyre mounted to rim by Goodgrip prior to dispatch) an extra cost for dis-mounting will charged. These are considered by law to be modified or customized goods and as such are not covered by the distance selling regulation right to cancellation as covered by Clause 7.2.

7.6. Any repayment from Goodgrip or refund to the Customer will made within 30 days the products being returned to Goodgrip undamaged and in original packaging and after the right to refund has been accepted and confirmed to the Customer in writing.

8. General

8.1 Whilst every effort is made by Goodgrip to ensure no such error or omission occurs, any typographical, clerical or other error or omission in any sales literature, price list, website text, acceptance of offer, invoice or other document or information issued by Goodgrip shall be subject to correction without any liability on the part of Goodgrip. The tyre tread pattern shown on product pictures may vary from the actual and product delivered to the Customer according to dimension changes relative to the particular size of the tyre due to the safety specifications of the tyre manufacturer.

8.2. The tyre information on the products is represented as provided by the tyre manufactures. Goodgrip doesn´t take any responsibility for inaccuracies in provided texts.

8.3. Any notice required or permitted to be given by either party to the other under these Conditions shall be in writing addressed to that other party at its registered office or principal place of business or such other address as may at the relevant time have been notified pursuant to this provision to the party giving the notice.

8.4. No waiver by Goodgrip of any breach of the Contract by the Customer shall be considered as a waiver of any subsequent breach of the same or any other provision.

8.5. If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.

8.6. The Contract and these Conditions shall constitute the entire agreement between the Customer and Goodgrip in respect of the supply of the Goods and shall supersede all previous oral or written representations or agreements relating thereto. In particular, the Customer may not rely on any statements made by any employee, representative or agent of Goodgrip.

8.7. Goodgrip may assign the Contract with the Customer or sub-contract the whole, or any part thereof to any other person (legal or otherwise) or entity. Unless otherwise agreed in Writing, the Customer may not assign either the benefit or the burden of any contract with Goodgrip.

8.8. The above terms and conditions are governed by and are to be construed in accordance with the laws of England and Wales. The buyer agrees to submit to the non-exclusive jurisdiction of the English Courts in the event of any dispute with these terms and conditions.
